Caso as atividades contribuam para atividades comerciais ou empresariais, a rela\u00e7\u00e3o passa a ser regida pela&nbsp;<a href=\"https:\/\/www.asg.co.mz\/a-nova-lei-do-trabalho-e-suas-alteracoes-substanciais\/\" target=\"_blank\" rel=\"noreferrer noopener\">nova Lei do Trabalho n.\u00ba 13\/2023 de 25 de Agosto<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Categorias de trabalhadores dom\u00e9sticos:<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Cozinheiro\/a<\/li>\n\n\n\n<li>Lavadeiro\/a<\/li>\n\n\n\n<li>Engomadeiro\/a<\/li>\n\n\n\n<li>Bab\u00e1 ou ama<\/li>\n\n\n\n<li>Jardineiro\/a<\/li>\n\n\n\n<li>Guarda residencial<\/li>\n\n\n\n<li>Motorista particular<\/li>\n\n\n\n<li>Empregado\/a de limpeza residencial<\/li>\n\n\n\n<li>Cuidador\/a de idosos ou pessoas dependentes<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Qual a legisla\u00e7\u00e3o para o trabalho dom\u00e9stico?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A&nbsp;lei que regulamenta o trabalho dom\u00e9stico em Mo\u00e7ambique&nbsp;\u00e9 o&nbsp;<strong>Decreto n.\u00ba 40\/2008, de 26 de Novembro<\/strong>, como um regime especial aut\u00f3nomo a Lei do Trabalho, e tem uma lei e regras pr\u00f3prias.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Direitos do empregado dom\u00e9stico<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">De acordo com artigo 10, s\u00e3o direitos do empregado dom\u00e9stico:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Receber a remunera\u00e7\u00e3o na forma acordada;<\/li>\n\n\n\n<li>Ter assegurado o descanso semanal e ferias anuais remuneradas;<\/li>\n\n\n\n<li>Ser tratado com dignidade e respeito;<\/li>\n\n\n\n<li>Fazer a inscri\u00e7\u00e3o por si mesmo no regime por conta pr\u00f3pria do sistema de seguran\u00e7a social obrigat\u00f3ria.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Deveres do empregado dom\u00e9stico<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">De acordo com o artigo 11, s\u00e3o os deveres do empregado dom\u00e9stico:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Comparecer ao servi\u00e7o com pontualidade e assiduidade;<\/li>\n\n\n\n<li>Comprimir com dilig\u00eancia e honestidade o trabalho acordado;<\/li>\n\n\n\n<li>Prestar obedi\u00eancia e respeito ao empregador, \u00e0s pessoas de sua fam\u00edlia e as que vivam ou estejam transitoriamente no seu lar;<\/li>\n\n\n\n<li>Observar as medidas de higiene e seguran\u00e7a no trabalho estabelecidas pelo empregador e pelas entidades competentes.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Deveres do empregador<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">De acordo com artigo 13, s\u00e3o deveres do empregador:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pagar pontualmente o sal\u00e1rio combinado;<\/li>\n\n\n\n<li>Tratar o empregado dom\u00e9stico com corre\u00e7\u00e3o e fornecer-lhe os meios necess\u00e1rios para execu\u00e7\u00e3o do seu trabalho;<\/li>\n\n\n\n<li>Prestar ao empregado dom\u00e9stico assist\u00eancia medica por acidentes de trabalho ou doen\u00e7as profissionais e satisfazer as respetivas indemniza\u00e7\u00f5es.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Idade para trabalhar como empregado dom\u00e9stico<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A idade m\u00ednima para trabalhar como empregado dom\u00e9stico \u00e9 de 15 anos. Por\u00e9m, deixa em aberto a possibilidade de contratar crian\u00e7as a partir dos 12 anos, com autoriza\u00e7\u00e3o dos pais ou representantes legais.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Sal\u00e1rio m\u00ednimo<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>O Decreto n\u00e3o estabelece um sal\u00e1rio m\u00ednimo<\/strong>, pois o Estado defende que existem empregadores que recebem abaixo do sal\u00e1rio m\u00ednimo e que, portanto, a defini\u00e7\u00e3o de um sal\u00e1rio m\u00ednimo para o sector criaria uma crise de desemprego e de cuidado.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Qual o hor\u00e1rio de trabalho?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">O per\u00edodo de trabalho do empregado dom\u00e9stico&nbsp;<strong>n\u00e3o pode ser superior a 9 horas por dia nem a 54 horas por semana<\/strong>, salvo acordo entre as partes. O trabalhador tem direito a&nbsp;<strong>30 minutos de intervalo di\u00e1rio para refei\u00e7\u00f5es e descanso<\/strong>, sem preju\u00edzo das fun\u00e7\u00f5es de vigil\u00e2ncia e assist\u00eancia ao agregado familiar.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Descanso Semanal<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">De acordo com o&nbsp;<strong>Artigo 21 do Decreto n.\u00ba 40\/2008<\/strong>, o trabalhador dom\u00e9stico tem direito a&nbsp;<strong>um dia de descanso por semana<\/strong>, que normalmente deve ser gozado ao&nbsp;<strong>domingo<\/strong>, exceto se as partes acordarem outro dia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Caso o trabalhador preste servi\u00e7os no dia reservado para descanso, ele tem direito a uma das seguintes compensa\u00e7\u00f5es:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Um&nbsp;<strong>dia de folga substituto<\/strong>;<\/li>\n\n\n\n<li>Ou&nbsp;<strong>remunera\u00e7\u00e3o equivalente<\/strong>&nbsp;ao dia de trabalho extra.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">O trabalhador dom\u00e9stico tem direito a f\u00e9rias?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">O&nbsp;<strong>Artigo 22<\/strong>&nbsp;do mesmo decreto estabelece que&nbsp;<strong>todo trabalhador dom\u00e9stico tem direito a f\u00e9rias anuais remuneradas<\/strong>, com dura\u00e7\u00e3o proporcional ao tempo de servi\u00e7o.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Veja como funciona a contagem:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>12 dias de f\u00e9rias no primeiro ano de trabalho;<\/li>\n\n\n\n<li>24 dias de f\u00e9rias no segundo ano;<\/li>\n\n\n\n<li>30 dias de f\u00e9rias por ano a partir do terceiro ano de trabalho efetivo.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Al\u00e9m disso, trabalhadores contratados por per\u00edodo&nbsp;<strong>entre 3 meses e 1 ano<\/strong>&nbsp;t\u00eam direito a&nbsp;<strong>1 dia de f\u00e9rias por cada m\u00eas de servi\u00e7o efetivo<\/strong>. (Artigo 22, n.\u00bas 2 e 5).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">O trabalhador dom\u00e9stico tem direito a sal\u00e1rio durante as f\u00e9rias?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Sim, tem direito e&nbsp;<strong>n\u00e3o pode ser inferior ao sal\u00e1rio que ele receberia se estivesse trabalhando normalmente<\/strong>. Isso garante que o trabalhador n\u00e3o seja penalizado financeiramente por exercer seu direito ao descanso. (Artigo 22, n.\u00ba 1 do Decreto n.\u00ba 40\/2008)<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Licen\u00e7a de maternidade<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Segundo o Artigo 24, n.\u00ba 6, al\u00ednea c),&nbsp;<strong>a empregada dom\u00e9stica tem direito a 60 dias de aus\u00eancia justificada por ocasi\u00e3o do parto<\/strong>, sem perda da remunera\u00e7\u00e3o.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00c9 obrigat\u00f3rio haver contrato?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>N\u00e3o.<\/strong>&nbsp;O contrato de trabalho dom\u00e9stico&nbsp;<strong>n\u00e3o est\u00e1 sujeito a uma forma obrigat\u00f3ria<\/strong>, podendo ser feito&nbsp;<strong>verbalmente ou por escrito<\/strong>, conforme estabelece o&nbsp;<strong>Artigo 6 do Decreto n.\u00ba 40\/2008<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Apesar disso,&nbsp;<strong>recomenda-se sempre a celebra\u00e7\u00e3o por escrito<\/strong>, especialmente quando o contrato for a&nbsp;<strong>prazo certo<\/strong>, pois nesses casos a forma escrita \u00e9 exigida por lei.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Modalidades permitidas por lei:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Contrato Por tempo indeterminado.<\/li>\n\n\n\n<li>Contrato A prazo certo ou incerto.<\/li>\n\n\n\n<li>Contrato Com ou sem alojamento.<\/li>\n\n\n\n<li>Contrato A tempo parcial ou a dias.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Indemniza\u00e7\u00e3o da empregada dom\u00e9stica por despedimento sem justa causa<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A empregada dom\u00e9stica<strong>&nbsp;s\u00f3 pode ser despedida com justa causa<\/strong>, e o&nbsp;<strong>empregador deve indicar por escrito os factos que justificam o despedimento<\/strong>&nbsp;(Artigo 30).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Se o despedimento for injusto<\/strong>, o trabalhador pode ter direito a uma&nbsp;indemniza\u00e7\u00e3o&nbsp;<strong>correspondente a 10 dias de sal\u00e1rio por cada ano de servi\u00e7o efetivo<\/strong>.
